Welcome to STAT Living, a housing platform designed specifically for medical professionals seeking short- and long-term lodging. By accessing or using our website and services (the “Platform”), you agree to comply with and be bound by these Terms and Conditions (the “Terms”). Please read them carefully before using our services.
1. Definitions
“Platform” refers to the website and related services operated by STAT Living.
“User” refers to anyone who accesses or uses the Platform, including both Hosts and Guests.
“Host” means any User who lists or offers a property for rent through STAT Living.
“Guest” means any User who books or stays at a listed property.
“Medical Professional” refers to individuals working in healthcare or related fields who use the Platform for housing related to travel, rotations, assignments, or similar purposes.
2. Eligibility
You must be at least 18 years of age.
You must be a verified medical professional or a Host providing lodging suitable for medical professionals.
You must provide accurate, current, and complete information during registration and maintain its accuracy.
STAT Living reserves the right to verify credentials, including medical licensure, employment, or property ownership.
3. Platform Role
STAT Living acts solely as a marketplace facilitator. We do not own, manage, or operate any of the listed accommodations.
The rental contract for a stay is directly between the Host and Guest. STAT Living is not a party to any rental agreement and does not guarantee the quality, safety, legality, or condition of listings.
4. User Accounts
Users are responsible for maintaining the confidentiality of their account credentials and all activity that occurs under their account.
Users must promptly notify STAT Living of unauthorized use.
Accounts may be suspended or terminated for violations of these Terms or misuse of the Platform.
5. Booking and Payments
All bookings made through the Platform are processed and governed by STAT Living’s policies.
Prices, fees, and applicable taxes are displayed at checkout.
Payments are processed through secure third-party processors.
STAT Living may charge service or processing fees, which are non-refundable unless otherwise specified.
STAT Living does not guarantee rent payment to Hosts. While we facilitate secure payment processing and will make reasonable efforts to collect funds from Guests, STAT Living is not responsible for unpaid, late, or delinquent payments. The Host acknowledges that rent payments are contingent upon Guest payment and assumes the risk of non-payment.
STAT Living will, at its discretion, attempt to contact and recover unpaid amounts from Guests, but is not obligated to pursue legal or debt collection actions on behalf of Hosts.
6. Cancellations and Refunds
Cancellations and refunds are governed exclusively by STAT Living’s official Cancellation Policy, which can be found in the Cancellation and Refunds section of our website.
By making a reservation, Users acknowledge that:
• The Cancellation Policy determines eligibility for partial or full refunds.
• Refunds, when applicable, are processed by STAT Living directly.
• STAT Living reserves the right to review and adjust refund decisions in cases involving fraud, emergencies, or documented extenuating circumstances.
• Hosts must honor all confirmed reservations unless otherwise directed by STAT Living.
7. Damage Claims and Liability
Guest Responsibility: Guests are responsible for any damage they cause to a Host’s property during their stay.
Guests may be held financially liable for verified property damage up to a maximum of $500, exclusive of applicable taxes, fees, or processing costs.
STAT Living does not guarantee recovery of damage amounts and is not responsible for pursuing legal or debt collection actions beyond this limit.
8. Code of Conduct
All Users agree to treat others with professionalism and respect, comply with all applicable laws and regulations, and refrain from discrimination, harassment, or misuse of the Platform.
Users agree to avoid sharing or soliciting personal contact information outside the Platform before booking (unless otherwise permitted by the Platform features and policies).
Violations may result in suspension or permanent removal from the Platform.
9. Listing Standards and Tax Responsibilities (For Hosts)
Hosts agree to provide accurate descriptions and images of their property, maintain a clean, safe, and habitable environment, and comply with all zoning, safety, and health laws.
Tax Responsibilities
STAT Living may, in certain jurisdictions, collect and remit lodging, occupancy, sales, or similar taxes on behalf of Hosts. When creating a listing, Hosts will be informed whether STAT Living will collect applicable taxes based on the property's location.
If STAT Living does not collect all applicable taxes for a listing, the Host is solely responsible for identifying, calculating, collecting, reporting, and remitting all required taxes to the appropriate governmental authorities.
Hosts who manually add any tax amounts to a listing or reservation are solely responsible for properly remitting those collected taxes to the correct taxing authorities.
Hosts may not collect taxes through the Platform unless they are properly registered with the relevant taxing authority and have provided a valid tax registration or identification number to STAT Living. STAT Living reserves the right to request documentation verifying tax registration before enabling manual tax collection features.
Failure to remit taxes collected through the Platform, failure to comply with applicable tax laws, or misrepresentation of tax status may result in immediate suspension or removal from the Platform, withholding of payouts, and/or reporting to appropriate authorities.
STAT Living is not liable for any tax underpayment, noncompliance, penalties, interest, or other liabilities arising from a Host’s failure to comply with applicable tax obligations.
10. Guest Responsibilities
Guests agree to respect the Host’s property, rules, and neighborhood, refrain from damaging or removing property, and notify the Host or STAT Living promptly of any issues during their stay.
Guests agree to leave the property in the same condition it was found.
11. Privacy Policy
Use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Platform, you consent to these practices.
12. Limitation of Liability
STAT Living is not liable for any injury, loss, or damage arising from stays or bookings; acts or omissions of Hosts, Guests, or third parties; technical errors, data loss, or interruptions in service; non-payment or delayed payment by any Guest; or Host or Guest noncompliance with tax obligations.
Our total liability to any User will not exceed the total amount paid to STAT Living in connection with the booking giving rise to the claim.
13. Dispute Resolution
Any dispute arising under these Terms shall first be attempted to be resolved amicably through mediation.
If unresolved, disputes shall be governed by the laws of the State of [Insert State] and handled in the appropriate courts therein.
14. Termination
STAT Living may suspend or terminate access to the Platform at any time, with or without cause, including for violations of these Terms or misuse of the service.
Suspension, Deactivation, and Removal
STAT Living reserves the absolute and unrestricted right, at any time and for any reason or for no reason, in its sole and exclusive discretion, and without prior notice, liability, or obligation to provide an explanation, to suspend, limit, deactivate, terminate, or permanently remove any user, listing, reservation, or account from the platform.
Use of the platform is a privilege, not a right.
Host Standards and Removal
Hosts must continuously meet all quality, safety, accuracy, cleanliness, legal, and professionalism requirements established by STAT Living. STAT Living may remove or deactivate any Host or listing at its sole discretion, including but not limited to situations involving:
• Complaints from Guests or third parties
• Cleanliness or maintenance concerns
• Safety risks or hazards
• Misrepresentation of a listing
• Failure to honor reservations
• Violation of laws, regulations, or community standards
• Conduct that may harm STAT Living’s reputation
• Any behavior STAT Living determines to be inconsistent with the expectations of the medical community
STAT Living is not required to conduct an investigation prior to removal and may rely on complaints, reports, or information from any source.
Guest Standards and Removal
Verification as, or representation of being, a medical or healthcare professional does not create any entitlement to use the platform. STAT Living may suspend or remove a Guest at any time, at its sole discretion, including but not limited to circumstances involving:
• Complaints from Hosts, neighbors, or building management
• Failure to follow house rules
• Cleanliness issues
• Property damage or misuse
• Unauthorized occupants or activities
• Disruptive, unsafe, illegal, or unprofessional behavior
• Any conduct STAT Living believes may negatively impact a Host, property, or the STAT Living community
No Right to Warning or Appeal
STAT Living has no obligation to provide warnings, mediation, refunds, credits, or appeal rights prior to or after suspension or removal.
Effect of Termination
Upon suspension or removal, access to the platform may be immediately revoked. STAT Living reserves the right to cancel upcoming reservations and take any action it deems necessary to protect its community, reputation, or operations.
15. Binding Arbitration and Class Action Waiver
Please read this section carefully. It affects your legal rights.
Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, any booking, or the relationship between a User and STAT Living shall be resolved by binding individual arbitration, and not in court.
Users waive any right to a trial by jury.
Users further agree that disputes may be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.
The arbitration shall be conducted in the State of Florida unless otherwise required by law.
STAT Living may seek injunctive or equitable relief in court for misuse of intellectual property, fraud, or circumvention of Platform protections.
16. Release of Claims Between Users
Because STAT Living is a marketplace facilitator and not a party to agreements between Hosts and Guests, Users agree that any dispute regarding a stay, property condition, cancellation, cleanliness, safety, or behavior is solely between the Host and Guest.
To the fullest extent permitted by law, each User releases STAT Living, its officers, employees, and affiliates from any claims, demands, damages, or liabilities arising out of or connected with disputes between Users.
17. No Warranty / Platform Provided “As Is”
The Platform is provided on an “as is” and “as available” basis.
STAT Living makes no representations or warranties of any kind, express or implied, including but not limited to:
• availability of listings
• accuracy of descriptions or photos
• suitability or safety of accommodations
• reliability of Hosts or Guests
• success of identity or credential verification
• uninterrupted or error-free operation
Use of the Platform is at the User’s own risk.
18. Indemnification
Users agree to defend, indemnify, and hold harmless STAT Living and its affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to:
• their use of the Platform
• their listing, stay, or conduct
• violation of laws or regulations
• breach of these Terms
• disputes with other Users
This obligation survives termination of the account.
19. Force Majeure
STAT Living shall not be liable for delays, cancellations, failures in performance, or inability to provide services resulting from events beyond its reasonable control, including but not limited to natural disasters, severe weather, pandemics, government actions, labor disputes, utility failures, internet outages, or emergencies.
20. Intellectual Property and Platform Use
All content, trademarks, logos, designs, text, graphics, and software on the Platform are owned by STAT Living or its licensors.
Users may not copy, reproduce, distribute, modify, scrape, or create derivative works without prior written permission.
Unauthorized use may result in termination and legal action.
21. Monitoring and Communications
STAT Living reserves the right, but not the obligation, to monitor, review, screen, or retain communications, listings, or activities conducted through the Platform for purposes of safety, fraud prevention, regulatory compliance, or enforcement of these Terms.
22. Fee Modifications
STAT Living may modify service fees, processing fees, or platform charges at any time. Updated fees become effective upon posting or notice.
Continued use of the Platform constitutes acceptance.
23. Fraud, Risk, and Chargebacks
If STAT Living suspects fraud, abuse, or violation of policies, it may suspend accounts, cancel reservations, withhold payouts, recover funds, or pursue collection.
Users remain financially responsible for chargebacks, reversals, penalties, or losses caused by their actions.
24. Survival
Any provisions that by nature should survive termination — including limitations of liability, releases, indemnification, arbitration, and payment obligations — shall remain in full force after an account is closed.
